29 CFR 1926.1101(f)(2)(i):  The employer with a work operation covered by the asbestos standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation:          a)   On or about October 24, 2014, and at times prior, Rocky Mountain Environmental, Inc., as a controlling employer, did not ensure that Sub At Best, LLC (subcontractor) protected their employees from airborne asbestos fibers while removing asbestos containing material (including surfacing material on drywall) in the absence of an initial exposure assessment.

29 CFR 1926.1101(h)(3)(iv)(A):  A tight-fitting powered air-purifying respirator or a full facepiece, supplied-air respirator operated in the pressure-demand mode and equipped with either HEPA egress cartridges or an auxiliary positive-pressure, self-contained breathing apparatus (SCBA) was not provided to employees in a regulated area performing Class I asbestos work for which a negative exposure assessment was not available and the exposure assessment indicated that the exposure level will be at or below 1 f/cc as an 8-hour time-weighted average (TWA):    a)  On or about October 24, 2014, and at times prior, Rocky Mountain Environmental, Inc., as a controlling employer, did not ensure that Sub At Best, LLC (subcontractor) provided employees performing Class I asbestos abatement work with a full-face powered air-purifying respirator or a supplied air respirator to protect them from asbestos fibers.  Employees were performing removal of asbestos containing dry wall texturing with only full and half face air purifying respirators.  A negative exposure assessment had not been conducted for this project.

29 CFR 1926.1101(g)(5)(i)[B][2]:  Electrical circuits in the enclosure shall be deactivated, unless equipped with ground-fault circuit interrupters:      a)  On or about October 24, 2014, and at times prior, Rocky Mountain Environmental, Inc., as a controlling employer, did not ensure that Sub At Best, LLC (subcontractor) protected their employees from electrical shock hazards while they worked inside an asbestos abatement enclosure in which all electrical circuits had not been deactivated or equipped with a ground-fault interrupter.  The wiring of the house (inside the walls) was not protected with ground-fault circuit interrupters.
