OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard.  On or about October 23, 2014, at the Walmart Neighborhood Market site, the equipment operator of a Case mini excavator, series CX27B was not wearing the seatbelt provided by the manufacturer while operating the excavator during site preparation.  Among other feasible methods, one feasible and acceptable abatement method would be to ensure that the operator(s) of the dozer have read and understand the safety, operation and maintenance instructions in the manual prior to operation, and utilize the seat belt provided by the manufacturer, such as specified by the operator's manual.
