29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.  On or about November 13, 2014, at the above addressed jobsite, the employer did not provide personal protection equipment such a gloves, and eye protection for employees exposed to Type M Mortar when performing mixing operations.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer: (Construction Reference 1926.103)  On or about November 13, 2014, at the above addressed jobsite, employees using 3M N95 filtering facepiece respirators, were not provided information contained in Appendix D of 29 CFR 1910, 134, for employees who were performing Type M Mortar mixing operations.
