29 CFR 1926.453(a)(2): Aerial lifts were "field modified" for uses other than those intended by the manufacturer, the modification had not been certified in writing by the manufacturer or by any other equivalent entity. Modification did not conform with all applicable provisions of ANSI A92.2-1969.      a) 797 State Route 9 Queensbury NY. - On or about November 24th, 2014 - Employees were exposed to fall, striking, and crushing hazards while using a field modified aerial lift as a crane.  The modification to the aerial lift was not certified in writing by the manufacturer or by any other equivalent entity.

29 CFR 1926.454(b): The employer did not have each employee who was involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question:      a) 797 State Route 9 Queensbury NY. - On or about November 24th, 2014 - Employees  operating an aerial lift were not trained by a competent person to recognize hazards associated with aerial lifts.  Employees were exposed to fall hazards while using a aerial lift.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:      Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.      a) 797 State Route 9 Queensbury NY. - On or about November 24th, 2014 - Employees were exposed to fall hazards while using an aerial lift.  A personal fall arrest system was not worn and/or a lanyard was not attached to the boom or basket when working from the aerial lift. 29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.      a) 797 State Route 9 Queensbury NY. - On or about November 24th, 2014 - An employee was exposed to fall hazards of 24 feet while climbing over a parapet wall onto the railings of an aerial lift.  The employee was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.
