29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:    In the alternative: 29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  a) 1491 Zeager Road, Elizabethtown PA - An employee was observed working from the top of a tank trailer without fall protection and was exposed to a 10 foot - 5 inch fall hazard to the ground below, on or about November 25 2014.  No abatement certification or documentation required.

29 CFR 1910.146(c)(7)(iii): The employer did not document the basis for determining that all hazards in a permit space had been eliminated, through a written certification that contained the date, the location of the space, and the signature of the person making the determination:  a) 1491 Zeager Road, Elizabethtown PA; Wash Bay - On November 25, 2014 and at times prior thereto, employees entered tank trailers to remove chocolate and the employer did not document through written certification, that all hazards in the permit space were eliminated.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
