29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: a. On or about November 26, 2014, in the facility, the employer had an inadequate personal protective equipment assessment which had not identified all the hazards necessitating the use of personal protective equipment. Employees were exposed to hazards including but not limited to fall, chemical and hot water splashes, which were not included in the hazard assessment.

29 CFR 1910.132(f)(1): The employer shall provide training to each employee who is required by this section to use PPE. Each such employee shall be trained to know at least the following: a. On or about November 26, 2014, in the facility, employees were not trained to know at least the following: 1. What PPE is necessary. 2. When PPE is necessary. 3. How to properly don, doff, adjust and wear PPE. 4. The limitations of PPE. 5. The proper care, maintenance, useful life and disposal of PPE. Employee exposure included, but was not limited to falls, methylene chloride and hot water, which were not included in the hazard assessment.

29 CFR 1910.151(c): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use. [63 FR 33450, June 18, 1998] a. On or about November 26, 2014, the employer had corrosive chemicals in the mechanical room. In the event of mechanical failure, employees could be exposed to the corrosive chemicals and had not been provided with an emergency drenching system to protect the eyes and body from exposure.

29 CFR 1910.1052(d)(2): Initial determination. Each employer whose employees are exposed to MC shall perform initial exposure monitoring to determine each affected employee's exposure, except under the following conditions: a. On or about July 9, 2014, in the maintenance shop, touch up and repair department, employees used material which contained methylene chloride to remove stickers and old decals. The employer failed to determine employee exposure to methylene chloride when performing tasks.
