OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to a fall hazard when using a manually propelled towable manlift: (a) Lumber Shed - On or about December 1, 2014 employees using a Bil-Jax Towable Manlift to access the roof of a lumber shed were exposed to fall hazards due to: (1) the employer not providing fall protection for the employees operating the manlift; and (2) the employer not providing training on safe operation of the manlift.

29 CFR 1910.23(a)(4):Skylights were not guarded by a standard skylight screen or a fixed standard railing on all exposed sides. (a) Lumber Shed - On or about December 1, 2014 employees were repairing a damaged skylight on the roof. The skylights were not guarded to prevent the employees from falling 26 feet through them to a lower level.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) Lumber Shed - On or about December 1, 2014 employees repairing a skylight on a roof without standard railings or personal fall arrest system. Employees were exposed to falling 26 feet to a lower level.
