29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures for voluntary respirator users:   a) Kissner Group/Magco Incorporated: The employer did not develop a written respiratory protection program for those employees who voluntarily wore,N-95 half-face, negative pressure, disposable respirators  Model #'s 905050A & 305060A]. These employees were observed pouring  dyes on the Calcium Magnesium Acetate [CMA]. This was observed on December 23, 2014.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:      a)Kissner Group/Magco Incorporated: The employer did not provide employees who donned N95, negative pressure, particulate respirators (Model #905050A and 305060A) with Appendix D of the respiratory protection standard. The employees voluntarily donned the respirators without being provided information regarding it's appropriate use. This was observed on December 23, 2014.

29 CFR 1910.1200(e)(1)(i): The written hazard communication program did not include a list of the hazardous chemicals known to be present, using an identity that was referenced on the appropriate material safety data sheet:  a) Kisser Group/Magco Incorporated: The employer did not presented a chemical inventory list which would include the hazardous chemical products which were being supplied and used by the employees. The products include, but were not limited to sodium chloride and calcium magnesium acetate. This was observed on December 23, 2014.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  Kissner Group/Magco Incorporated - Employees were provided and used chemicals such as, but not limited to, Calcium Magnesium Acetate [e.g. salt] and sodium chloride [e.g.color/tinted liquids for the salt]. The employer did not provide the employees, upon hire, training regarding the hazards of the chemicals being used. This was observed on December 23, 2014.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  a) Kissner Group/Magco Incorporate Incorporated. - Employees who handle hazardous chemical products [ Road Salts and Milliken Brilliant Colors; orange, blue-hp, green-hmc, bright yellow and pink], were not provided training on the new labels and safety data sheet format which was instituted in December of 2013. This was observed on October 30, 2014.
