29 CFR 1926.501(b)(15): "Walking/working surfaces not otherwise addressed." Except as provided in 1926.500(a)(2) or in 1926.501 (b)(1) through (b)(14), each employee on a walking/working surface 6 feet (1.8 m) or more above lower levels shall be protected from falling by a guardrail system, safety net system, or personal fall arrest system.   On 12/02/2014 three employees of Raw Sheet Metal, LLC, were observed working at a commercial building restoration project located at 2221 High School Drive, Saint Louis, MO 63144.The three men were working at 12 feet over the lower level that was the ground. While on the overhead walkway canopy they were engaged in reconstruction repair work, without the use of any fall protection. The overhead canopy height was approximately 12 feet ground to eave. No other means of a guardrail system, safety net system, or personal fall arrest system was present at the time of the inspection.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   On 12/02/2014 three employees of Raw Sheet Metal, LLC, were observed working at a commercial building restoration project located at 2221 High School Drive, Saint Louis, MO 63144.The three men were working at a height of 12 feet. All employees were utilizing the ladder as a main access to the elevated canopy walkway. The ladder was not extended three feet above the upper landing surface to which the ladder is used to gain access.
