29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about 12/02/2014 at the Party City Construction Project, employees were working from a roof deck with no fall protection system in use.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about 12/02/2014 at the Party City Construction Project, employees were using a ladder that did not extend at least 36 inches past the roof deck to access and descend to and from the roof deck.
