29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a)At the site employer didn't have a competent person to inspect the excavation for hazards prior to assigning work to employees who were exposed to caught in hazard while in a 6 feet 5 inches deep excavation performing a concrete drilling/cutting operation on the west side of the existing man hole, on or about 12/3/2014.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). (a) At the site employees were exposed to a caught in hazard after entering a 6 feet 5 inches deep excavation to perform a concrete drilling/cutting operation on the west side of the existing man hole, in that, no protective system was provided, on or about 12/3/2014.
