29 CFR 1903.19(c)(1): Within ten calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section:  a.  The employer has failed to submit abatement certification within ten days of the abatement date, February 3. 2015, for a violation of 29 CFR 1926.503 (c), issued as citation 1, item 2, and described as follows:  Located at 314 Sycamore Woods Lane in Gahanna, Ohio, employees were performing roofing work on a residential home without all employees wearing a complete fall arrest system, due to the retraining of employees being inadequate, thereby exposing the employees to a fall hazard of approximately ten to 20 feet.  b.

29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.  a.  Located at the site, employees were operating pneumatic nail guns without wearing eye protection, thereby exposing the employees to permanent eye loss.

When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where:  29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  a. 29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  29 CFR 1926.602(d): Powered industrial truck operator training.  Note: The requirements applicable to construction work under this paragraph are identical to those set forth at ��1910.178(l) of this chapter.  1.  Located at 314 Sycamore Woods Lane in Gahanna, Ohio, an employee was operating a 100R4 Skytrak rough terrain forklift without successfully completing the training that was required to operated a powered industrial vehicle, thereby exposing the employee to the hazards associated with forklift operation.
