29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. A.) W.D. Wright Contracting, Inc., 441 Highland Avenue, Meadville, PA 16335, on or about December 5, 2014: Employees on-site were utilizing a Champion Global Power Equipment generator (M/N: 46595, S/N: 14JAN0301118) and an extension cord to power a pump in an excavation. Ground-fault circuit interrupter (GFCI) protection was not utilized. The generator was not equipped with a ground-fault circuit interrupter (GFCI), nor was an in-line GFCI used in conjunction with the extension cord and flexible electrical cords. In addition, an assured equipment grounding program (AEGP) was not being utilized as an alternate means of protection.
