29 CFR 1910.132(d)(1): Hazard assessment and equipment selection. The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:    29 CFR 1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;    On or about December 4, 2014, the employer had not performed and documented a personal protective equipment hazard assessment to determine and select the required PPE to be used for the chemical and thermal hazards present in the workplace. Employee exposure includes chemical hazards from phosphoric acid during the preparation of sanitation chemicals and thermal hazards from steam use in the cooking processes.

29 CFR 1910.147(c)(4)(ii): General.  Energy Control  Procedure.  The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the 29 CFR 1910.147(c)(4)(ii)(A-D):    a. On or about December 4, 2014, the employer had not established, documented and enforced the use of specific machine and/or equipment procedures for control of hazardous energy (Lockout/Tagout.)  Equipment and/or machines covered by this part include, but is not limited to, Grinders, Mixer Grinders, a Screw Conveyor, the Steam Ovens (Steam Generator) and the Instant Quick Freeze machine.  Due to this condition, employees performing required duties, such as sanitation preparation (tear down) and sanitation activities, are exposed to struck-by and caught-in hazards associated with unexpected energization of equipment and/or machines.

29 CFR 1910.147(d)(3): Application of control.  Machine or equipment isolation. All energy isolating devices that are needed to control the energy to the machine or equipment shall be physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s):  On or about December 4, 2014, energy isolating devices were not applied, located and placed in a manner to control hazardous energy. When performing required duties, devices, such as locks, and lockout hasps, are not placed on disconnect switch boxes, or individual circuit breakers in subpanel boxes to isolate the energy source. Due to this condition, employees are exposed to potential caught-in or stuck-by hazards associated with the energization of Grind room equipment during teardown and sanitation.

29 CFR 1910.147(c)(7)(i): Training and communication.  The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:    29 CFR 1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control:  a.  On or about December 4, 2014, the employer did not provide training specific to the use of energy isolation devices for employees performing required duties covered by this part. Authorized employees without training in applying or using the methods and means necessary for adequate hazardous energy control (Lockout/Tagout) include, but are not limited to, Grinding room production employees performing end of shift equipment "teardown" and Grind room sanitation employees. Energy isolation devices, such as locks and lockout hasps, are not applied to electrical disconnect boxes during santitation preparation and sanitation activities. Due to these conditions, employees have increased risk of injury related to struck-by and caught-in hazards associated with potential unexpected equipment energization.

29 CFR 1910.305(g)(2)(iii): Flexible cords and cables.  Identification, splices, and terminations.  Flexible cords and cables shall be connected to devices and fittings so that strain relief is provided that will prevent pull from being directly transmitted to joints or terminal screws:    a.  On or about December 4, 2014, in the Processing building Grind room, the block conveyor motor electrical power supply strain relief device was damaged and pulled out from the motor. Due to this condition, employees have exposure to an electrical contact hazard and have increased risk for electrocution.    b. On or about December 4, 2014, in the Processing building Grind room, there were two junction boxes for "ceiling drops" that provide electrical power for equipment such as Grinders and the patty making machine. Due to this condition, employees have exposure to an electrical contact hazard and have increased risk for electrocution.
