On or about December 1, 2014, at the boiler installation area, the employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely and exposed employees to struck-by and crushing hazards.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area (Construction Reference: 1926.59):   a. On or about December 1, 2014, at the boiler installation area, employees were not provided effective information and training on hazardous chemicals in their work area, such as but not limited to, acetylene, topcoat/aerosols and propane cylinders at the time of their initial assignment.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information (Construction Reference: 1926.59):  a. On or about December 1, 2014, employees used hazardous chemicals such as, but not limited to acetylene, topcoats/aerosols and propane cylinders while working at the boiler installation lay down yard and the employer did not provide an explanation of the new labeling system and safety data sheet as required under the new hazard communication program (GHS 2012).
