29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). The employer does not ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected by a fall protection system. This violation occurred on or about December 8, 2014, at the worksite, employees were exposed to a fall hazard of 10 feet while performing framing work on the second level of a residential building being constructed without a fall protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employees engaged in residential construction activities at heights of six feet or more are protected from falling.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided. The employer does not provide proper access to the employees where there is a break in elevation of 19 inches or more. This violation was observed at the construction site on December 8, 2014 where employees were exposed to a 10 ft. fall hazard when employees were using the frame of the structure to ascend and descend the roof of a residential construction without stairways or ladders. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provide with stairways or ladders where there is a break in elevation of 19 inches or more.
