OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to fall hazard in the workplace. On or about December 11, 2014 at 96 Lafayette Drive, Unit 109, Syosset, NY 11791: An employee was elevated by a 40 - Hyster forklift approximately 8 to 9 feet above ground while standing on a wooden pallet that was used for platform without guardrails or personal fall arrest systems in use. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
