OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees where they were exposed to struck-by and crushed-by hazards:    On or about December 9, 2014, in the welding shop, employees were lifting and moving material on two overhead hoists and safety latches were missing:      a.  On the 1 ton CM hoist, series 622, (no serial number) was not inspected and the safety latch on the hook was missing.      b.  On the 2 ton Pittsburgh hoist, model number 631J (no serial number) was not inspected and the safety latch was missing.

On or about December 9, 2014, and times prior thereto, bench grinders used by employees were not equipped with a work rest exposing employees to caught-in and struck-by hazards. the employer did not ensure that all equipment used to aid in shaping and/or grinding material was inspected, such as but not limited to:          a.  The Vangil bench grinder (no serial number) was not equipped with a work rest,         b.  The Wissota table grinder. model no. E33G, (no serial number) was not equipped with a work rest,          c.  The Baldor bench grinder, (no data plate)  was not equipped with a work rest,         d.  The Cummings bench grinder (no data plate) was not equipped with a work rest.

29 CFR 1910.215(b)(9): Guard for abrasive wheel machine where the operator stands in front of the machine was not constructed so that the peripheral protecting member could be adjusted to the constantly decreasing diameter of the wheel:  On or about December 9, 2014, and times prior thereto, bench grinders did not have tongue guards installed to protect against flying debris exposing employees to struck-by hazards.                a)     Machine Shop:  The Vangil bench grinder, was missing the safety glass shield.             b)     Machine Shop:  The Wissota bench grinder, Model number E33G, was missing the safety glass shield.             c)     Machine Shop:  The Baldor bench grinder, was missing the safety glass shield.              d)     Weld Shop:  The Cummings bench grinder, SN N6-63, was missing the safety glass shield.
