29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: On or about December 11, 2014, and at times prior thereto, the employer did not provide hazard recognition training for employees performing activities including, but not limited to, working on the edges of the top plates of the newly constructed apartment complex frame. Employees were working without any form of fall protection and were exposed to a fall hazard greater than 6 feet.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: On or about December 11, 2014, and at times prior thereto, employees were working on the edges of the top plates of the newly constructed apartment complex frame without any form of fall protection and were exposed to a fall hazard greater than 6 feet.

29 CFR 1926.1053(b)(4): Ladders were not used for the purpose for which they were designed: On or about December 11, 2014, and at times prior thereto, an employee used an 8 foot A-frame Louisville ladder to access the top plates of the apartment complex frame. The ladder was not set properly and was positioned at an angle on the northeast corner of second level of the apartment complex frame. The employee was exposed to a fall hazard of greater than 6 feet.
