29 CFR 1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person: On or about December 10, 2014, the employer failed to ensure that a qualified person constructed the scaffold system located at 2601 David Drive, Metairie, LA. Employees were climbing the metal frame of the scaffold to gain access to the second level of the scaffold.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access. On or about December 10, 2014, on the west side of the building, the employer allowed employees to climb the metal framing of a scaffold system in order to access an upper level of the scaffolding.
