29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  The employer does not use ladders or means of access for scaffold more than 2 feet above or below a point of access. This violation was observed on or about December 9, 2014, on the west side of a newly built residential dwelling where an employee was observed exposed to a 7 foot fall hazard when installing bricks from fabricated frame scaffolding without a ladder or similar means of access.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that when scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface are used.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.  The employer does not protect employees on a scaffold more than 12 feet above a lower level from falling to that level. This violation was observed on or about December 9, 2014, on the SE side of a newly built residential dwelling where an employee was observed exposed to a 12 foot fall hazard when installing bricks from fabricated frame scaffolding without a fall protection system.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee on a scaffold more than 10 feet above a lower level is protected from falling to that lower level.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   The employer does not protect employees engaged in residential construction activities 6 feet or more above a lower level by use of a fall protection system. This violation was observed on or about December 9, 2014, on the south/front side of a newly built residential dwelling where an employee was exposed to a 10 foot fall hazard when installing bricks from a low sloped roof overhang without fall protection.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are protected by guardrail systems, safety net system, or personal fall arrest system, or employee(s) are provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).
