OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard.    Employees were exposed to fall hazards when performing the following activities:     a) Facility: Employee(s) were elevated approximately 12 feet above the ground while standing on the forks of powered industrial vehicles to gain access to the mezzanine to retrieve cardboard boxes containing company records.    b) Facility: Employee(s) were elevated approximately 12 feet above the ground while standing on the forks of powered industrial vehicles to gain access to the mezzanine to retrieve products from shelving units.    Among other methods, one feasible and acceptable abatement method to correct this hazardous condition is to ensure that employee(s) use a work platform that complies with the design requirements in ANSI B56.1-2000.    No abatement documentation or certification required for this item.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe boards.  Note: toeboards are only required when persons can pass, there is moving equipment, or there is equipment with which falling materials could create a hazard.    Mezzanine: Employees were exposed to a 12 foot fall hazard while accessing the mezzanine to retrieve cardboard boxes containing company records and the employer did not ensure a guard rail was installed on the mezzanine.    No abatement documentation required for this item.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  Facility: The employees required to work with chemicals such as, but not limited to propane and printing inks have not been trained on the safety and health hazards to help prevent or eliminate burns and skin irritation.
