29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides, On or about December 15, 2014,an employee was required to use a platform approximately 8 feet high in the area where equipment was being assembled. The platform was missing a standard railing exposing the employee to falls hazards.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. On or about December 15, 2014, in the work area, the employees were required to use a manlift on the forklift that was not approved for the use by the manufacturer. The employees were thereby exposed to the hazards associated with falls.

29 CFR 1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered. a. On or about December 15, 2015, in the work area, the forklift used to raise employees in the manlift was not marked properly to identify the attachments and to prevent overloading of the lift.
