29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  On December 16, 2015, the employer failed to provide a written certification which identified the workplace hazard assessment evaluated. Employees were exposed to chemical hazards when performing metal stripping, and metal working procedures.

29 CFR 1910.1200(b)(4)(ii): Employers shall maintain copies of any material safety data sheets that are received with incoming shipments of the sealed containers of hazardous chemicals, shall obtain a material safety data sheet as soon as possible for sealed containers of hazardous chemicals received without a material safety data sheet if an employee requests the material safety data sheet, and shall ensure that the material safety data sheets are readily accessible during each work shift to employees when they are in their work area(s); and,  On December 16, 2014, the employer failed to provide a copies of MSDSs for chemicals such as but not limited to sulfuric acid and cutting oils utilized with the workplace., including the chemical stripping process.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:   On December 16, 2014, the employer did not develop, implement and maintain a written hazard communication program that addressed labeling, training and safety data sheets for chemicals, including metal cutting oils.
