29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) Worksite, 510 Halsey Lane, Bridgehampton, NY- Employees were not wearing head protection directly below tools and materials overhead; on or about 12/12/2014.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    a) Worksite, 510 Halsey Ave., Bridgehampton, NY - Employees using a pneumatic nail gun to install roofing shingles were not using eye protection; on or about 12/15/14.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) Worksite, 510 Halsey Ave., Bridgehampton, NY- Employees were installing roofing materials while standing several inches from the roof edge at a height of approximately 22' above the ground below. The employees were working without fall protection; on or about 12/12/14.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.    a) Worksite, 510 Halsey Ave., Bridgehampton, NY, back roof of residence- Employee was using an extension  ladder to access the back, west-facing roof of the residence. The ladder side rails did not extend beyond the roof upper landing surface; on or about 12/15/2014.     Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
