29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) On December 17, 2014, at the facility located at 607 NE 69th St. - Kansas City, MO., The employer had not ensured that Powered Industrial Truck Operator had successfully completed the required training and evaluation prior to operating the forklift in the facility. The operator had been working and operating the forklift for the employer for approx. 6 years without receiving the training and evaluation. Note: After the initial training and evaluation, the employer must ensure that all operators are re-evaluated every three years. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

(a) On December 17, 2014, at the facility located at 607 NE 69th St. - Kansas City, MO., The employer did not ensure that the Mitsubishi Powered Industrial Truck, Serial Number AF814-51683 was free of defects , in that the following equipment was in need of repair: (1) Emergency Brake was inoperative and would not hold. (2) The Operators Seat was badly worn and in need of replacement. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
