OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards due to combustible metals being stored in the vicinity of employees operating a Stihl TS410 chop saw. a) Employees are using a Stihl TS410 chop saw to cut pipes and radiators creating sparks in proximity to 55 gallon drums which are used to store metal grindings exposing employees to fire hazards.

29 CFR 1910.1200(e)(1): The employer had not developed or implemented a written hazard communication program including the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a) At the facility, on or about December 18, 2014 - The employer did not develop or implement a written hazard communication program. 55-gallon drums with metal grindings including, but not limited to, zinc, aluminum and magnesium, are stored in the vicinity of employees creating a spark shower while using a Stihl TS410 chop saw.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section: a) At the facility, on or about December 18, 2014 - A 55-gallon drum containing a mixture of metal grindings was not labeled, tagged or marked with information specified under paragraphs (f)(6)(i) through (f)(6)(ii). The metal grindings included, but were not limited to, zinc, aluminum and magnesium which are readily combustible solids.
