29 CFR 1910.178(l)(4)(iii): This provision is applicable to construction employment by 29 CFR 1926.602(d). 29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: Worksite located at 12916 Millard Airport Plaza, Millard, NE and throughout the company: The employer failed to ensure that each employees operating a powered industrial truck has received an evaluation at least every three years. An employee operating a fork truck at the site has not had training or an evaluation since April of 2010. Abatement certification is required for this violation. 29 CFR 1910.178(l)(6) This provision is applicable to construction employment by 29 CFR 1926.602(d). 29 CFR 1910.178(l)(6): The certification did not include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation: Worksite located at 12916 Millard Airport Plaza, Millard, NE and Throughout the Facility: The employer failed to ensure that written certification for each fork truck operator was written and maintained as outlined in the standard. This should include the dates of training, the instructor names, and the name of the operator.
