OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling and/or being thrown from a powered industrial truck: a) In front of the building, on or about December 17, 2014, an employee was exposed to fall hazards associated with working 10-12 feet above the paved ground from the forks of an elevated powered industrial truck (PIT).

29 CFR 1926.453(b)(2)(iv): Employee(s) working in an aerial lift were not standing firmly on the floor of the basket: a) In front of the building, on or about December 17, 2014, two employees working from an aerial lift, Genie S-40 Boom Lift Model 712721, used the mid-rail to get in and out of the personnel basket, and did not remain flat footed while elevated, which exposed the employees to ejection and fall hazards up to about 12 feet.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. a) In front of the building- on or about December 17, 2014, two employees were observed using an aerial lift without the use of a body belt and lanyard attached, exposing them up to a 12-foot fall hazard.
