29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors: Inside the structure under construction: There was no assured equipment grounding conductor program, and the ground-fault circuit-interrupter did not function on the receptacle that supplied power through an extension cord to a 110 VAC DeWalt screw gun, model number DW 268. Employees, on ladders, using extension cords and screw guns to attach sheet metal siding to the bottom of a roof soffit on the west side of the structure, were exposed to the hazards of contacting electricity.

29 CFR 1926.602(c)(1)(i): All industrial trucks in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks, 606 OPERATOR CARE OF THE TRUCK, A. Special consideration was not given to the proper functioning of tires, horn, lights, battery, controller, lift system (including load engaging means, chains, cable, and limit switches), brakes and steering mechanism. When at any time a powered industrial truck was found to be in need of repair, defective, or in any way unsafe, the matter was not reported immediately to the designated authority, and the truck was not taken out of service until it has been restored to safe operating condition: Inside the structure under construction: The horn button was missing on a high lift forklift, Skytrack 10042, and it was not taken out of service. The forklift was used to move insulation around the interior of the building and to lift it to the roof level. Employees working around the lift were exposed to the hazard of being struck by the lift.
