Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard:    On or about December 16, 2014, and at times prior thereto, the employer provided unsafe means to lift personnel performing general housekeeping duties in that a Toyota Forklift Model  8FGCU15 was used to support platforms, exposing employees to the hazards of falls.  a) employee working from pallet raised on the forks with no fall protection and no one at the forklift controls.  b) employees working in unapproved, unmarked basket attached with a chain.
