29 CFR 1926.451(e)(6): Integral prefabricated scaffold access frames did not meet the requirements of paragraphs (e)(6)(i)-(vi) of this section: (a)Rise & Shine LLC at 4956 Saddlewood Circle, Johnstown, CO 80534: On and before December 10th, 2014, the employer did not ensure adequate access was provided to scaffolding platforms. The employer allowed employees to access the elevated scaffold platforms by using the prefabricated scaffold frames, even though the frames were not designed for such use. The access frame rungs were only 6 inches wide, were not evenly spaced, and were placed 34 inches above the ground, and 34 inches above the first platform. The condition exposed employee to fall hazards of up to 14'6".

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet above the lower level, was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: a) Rise & Shine LLC at 4956 Saddlewood Circle, Johnstown, CO 80534: On or about December 10, 2014, the employer allowed employees to conduct stucco work on this fabricated frame scaffold without the use of fall protection. A materials platform was used as a guardrail, even though it was not fully planked, and could shift if a sideways load was placed against it. In addition, the working platform was missing end rails. No personal fall arrest system was in use. Conditions exposed employee to fall hazards of up to 14'6".
