29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.  The employer does not protect employees from falling when working 6 feet or more above lower levels, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems. This violation was observed on or about December 15, 2014, at the construction site where an employee was exposed to an approximate 31 foot fall hazard when framing the roof on a multi-family residential structure without a fall protection system.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employees engaged in residential construction activities at heights six feet or more are protected from falling.
