OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards in the Garage: Two overhead garage doors approximately 12 feet wide did not have safety device edges or door stop sensors to prevent struck-by hazards to employees. Employees are exposed to this hazard while transporting motorcycles, equipment and material to and from the parking, storage area, and the maintenance bay. The electrically-powered doors are not equipped with safety device edges or door stop sensors that would initiate retraction or stop closure in the event the doors begin closing while an employee is underneath, resulting in a struck-by hazard.    The industry recognizes that operating an overhead garage door without a safety device edge or door stop sensor is a hazardous condition, as outlined in ANSI/UL 325 and NFPA 80.           Note: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
