OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized struck-by hazards that were causing or likely to cause death or serious physical harm to his employees:    (a)  In the warehouse, at least one employee who was operating a Toyota powered industrial truck without a safety belt, was exposed to struck-by hazards.    (b)  In the warehouse area, employees were exposed to struck-by hazards while working near and around the storage racking system that was not anchored to the ground to prevent displacement; and, did not have plaques containing the maximum permissible unit load and/or maximum uniformly distributed load per level, and/or the racking system did not have the maximum total load per bay.

29 CFR 1910.22(d)(1): In every building or other structure, or part thereof, used for mercantile, business, industrial, or storage purposes, the loads approved by the building official were not marked on plates of approved design which were not supplied and securely affixed by the owner of the building, or his duly authorized agent, in a conspicuous place in each space to which they relate. Such plates are not be removed or defaced but, if lost, removed, or defaced, will be replaced by the owner or his agent:    (a) The approximate 3,500 square foot overhead storage area above the welding department had not been rated to determine its maximum load capacity, to protect against collapse.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment was not isolated from the energy source and rendered inoperative:    (a)  Employees perform service and/or maintenance work on machinery, including but not limited to the hydraulic press brake, without isolating the machine from the energy source and rendering it inoperative.

The guarding device were not in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, were not so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle:    In the punch area, employees are using:    (a) Truma Bend C120 press brake without the use of a guard    (b) A TruBent 3066 press brake without the use of a guard.
