29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that fall hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the fall hazard: (a) On or about April 27, 2015, and at times prior to, employees performing work on elevating operator platforms were exposed to fall hazards in that the personal protective equipment provided by the employer would allow employees to strike the ground at elevated heights less than 9.5 feet.
