29 CFR 1910.106(b)(6): "Sources of ignition." In locations where flammable vapors may be present, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition. Sources of ignition may include open flames, lightning, smoking, cutting and welding, hot surfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat: a) 5155 High Street, Belgrade MT; On or about December 30, 2014 and at times prior, employees were exposed to fire and explosion hazards while delivering and transferring Class 3 Flammable Liquids into a petroleum storage tank without ensuring all sources of ignition were eliminated.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: a) 5155 High Street, Belgrade MT; On or about December 30, 2014 and at times prior, employees were exposed to fire and explosion hazards while performing the non routine task of delivering and transferring Class 3 Flammable Liquids into petroleum storage tanks such as but not limited to the 6,000 gallon underground fuel storage tank repurposed for use as an above ground fuel storage tank.
