29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: At the worksite located at 3901 SW 21st Street in Topeka, Kansas, during excavation and concrete pipe installation activities, an employee assisting with pipe rigging tasks was not protected from struck by hazards in that no hard hat was worn. An excavator was actively working in the trench along with the employee.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: At the worksite located at 3901 SW 21st Street in Topeka, Kansas, employees were conducting excavation and concrete pipe installation activities in a trench approximately 6 foot deep and more than 35 feet long. Employees were exposed to injuries in that a ladder was not placed in the excavation to provide safe entry and egress.

The soil removed from the trench was placed along side of, and directly on, the edges of the excavation.
