29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: On or about January 1, 2015 it was mandatory for fabricating employee to wear an elastomer (half mask) respirator while welding and grinding metal. Employee's were not provided a medical evaluation prior to being issued an elastomer respirator.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT): On or about January 1, 2015, it was mandatory for employees to wear elastomer respirators while plasma cutting, welding or grinding metal. Employee's fit testing procedure was not in accordance with 1910.134 Appendix A.
