29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    a.  The employer did not ensure that a monitoring program was implemented when information indicated that employee exposures equaled or exceeded the 8-hour time-weighted average of 85 decibels.  This violation occurred on or about January 7, 2015 when the employer allowed employees to be exposed to occupational noise that equaled or exceeded the 8-hour time-weighted average of 85 decibels when working around noisy equipment such as but not limited to airboats, air compressors, water jet pumps, and heavy equipment.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:    a. The employer did not ensure that an audiometric testing program was established and maintained by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels.  This violation occurred on or about January 7, 2015 when laborers exposed to noise at levels equal to or exceeding an 8-hour time-weighted average of 85 decibels were not provided audiometric testing.

The employer did not ensure that employees exposed to noise at or above an 8-hour time-weighted average of 85 decibels were trained.  This violation occurred on or about January 7, 2015, when laborers exposed to noise an 8-hour time-weighted average of 85 decibels were not trained in accordance with the requirements of 29 CFR 1910.95(k).

29 CFR 1910.134(h)(3)(ii)(A): Respirator inspections did not include a check of respirator function, tightness of connections, and the condition of the various parts including, but not limited to, the face piece, head straps, valves, connecting tube, and cartridges, canisters or filters:    a.  The employer did not ensure that the respirator inspection included a check of respirator function, tightness of connections, and the condition of the various parts including, but not limited to, the face piece, head straps, valves, connecting tube, and cartridges, canisters or filters.  This violation occurred when the employer allowed an employee to use an airline respirator for sandblasting inside a cofferdam without checking the air line connecting tube prior to use.  The airline connecting tube has a melted area which allowed a pinhole air leak during use.
