29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces: In the yard, on January 7, 2015 a drilling mud/gas separator that had been returned from Patterson UTI Rig #518 for cleaning on or about January 5, 2015 was not posted as a permit-required confined space. The separator was contaminated with residues from circulation through the hole including, but not limited to, diesel-based mud, crude oil, and hydrocarbons, exposing employees to potential oxygen deficient atmospheres and/or inhalation of toxic gases or vapors in the event of entering the tank.

29 CFR 1910.146(c)(3): When the employer decided its employees would not enter permit spaces, the employer did not take effective measures to prevent its employees from entering the permit spaces: In the yard, on or about January 6, 2015 the manway cover was removed from a drilling mud/gas separator that had been returned from Patterson UTI Rig #518 the previous day for cleaning, and was not secured back in place to prevent entry. The separator was contaminated with chemical residues from circulation through the hole including, but not limited to, diesel-based mud, crude oil, and hydrocarbons, exposing employees to potential oxygen deficient atmospheres and / or inhalation of toxic gases or vapors in the event of entering the tank.
