OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to being struck by the refuse collection truck. (a) Refuse Collection Truck: Employees drive, operate and load the truck with curbside refuse in a variety of communities. Employees had not been provided effective methods or procedures and training with regard to the hazards and methods to prevent injury and death, on or about January 7, 2015.
