29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  On or about January 7, 2015, employees were required to wear half face respirators while cleaning frac and crude oil tanks and the employer did not develop or implement a Written Respiratory Protection Program.

29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  On or about January 7, 2015, employees were not fit tested for half face respirators used during cleaning of frac and crude oil tanks.

29 CFR 1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with this section. The written program shall be available for inspection by employees and their authorized representatives.   On or about January 7, 2015, employees were involved in tank cleaning operations at the wash pad area on the south side of the job site, and the employer did not develop and implement a written permit space entry program.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:  On or about January 7, 2015, half face respirators were hung on the south wall of the storage trailer in front of a window exposed to sunlight and dust with no covering.
