29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition:    a.  On or about March 18, 2015,  at the Regrind area where employees and temporary employees worked daily, hazardous accumulations of plastic dust,  a combustible dust,  generated during grinding/recycling operations,  were allowed to accumulate on surfaces,  including: process equipment, electrical equipment, adjacent equipment, and floor surfaces.  The employer did not establish a formal cleaning schedule to ensure that plastic dust did not accumulate.  Employees were thereby exposedto the hazards associated with smoke and fire.

29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a.  On or about January 9, 2015,  in the facility,  employees and temporary employees were required to operate powered industrial vehicles during plastics recycling operations.  The employer did not ensure that each powered industrial truck operator completed the required training & evaluation specified in paragraph (l).

Caterpillar 50 Model GC25 SN 5EM00656 - The vehicle's exhaust contains 5.85% carbon monoxide    3. Toyota Model 42-6FGCU18 SN 61608 Vehicle ID 18 TO3396 (60) - The vehicle's exhaust contains 4.57% carbon monoxide    4. Nissan 40 Model CPJ02A20PV  Chassis #CPJ02-9P1322  - The vehicle's exhaust contains 5.72% carbon monoxide    5. Toyota Vehicle ID 501 (missing identifiaction plate)  - The vehicle's exhaust contains 2.73% carbon monoxide; broken / missing seat belt;  broken front right headlight; horn broken, emergency brake not working    6. Toyota Model 5FGC25 SN5FGCU25 SN 83128 - The vehicle's exhaust contains 2.88% carbon monoxide      b.  On or about March 18, 2015, in the facility, powered industrial truck(s) with defect or in any way unsafe had not been withdrawn from service until responded to safe operating condition as follows:     1. Toyota Vehicle ID 396 The vehicle's exhaust contains 3.8% carbon monoxide    2. Toyota Vehicle ID 498 14887 Model 7FGCU25 SN 73382 - The vehicle's exhaust contains 3.28% carbon monoxide

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:   a.  On or about January 9, 2015,  in the facility,  powered industrial vehicles were in use to load and unload recycled plastic products.  Powered industrial vehicles used by employees and temporary employees daily were not examined before use. Employees were thereby exposed to the hazards associated with defective industrial trucks.
