29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a) 9 Shady Path, Bridgehampton, NY (Worksite), 1st Floor Master Bedroom  Employees removed and installed insulation in an attic area directly above the 1st floor master bedroom, without any form of fall protection. The employees worked and traversed across the open 2 x 12 engineered floor joists and were exposed to falls of up to 10 to the next lower level on, or about January 11, 2015.      Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19. Failure to comply may result in an additional penalty of $1,000.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) Worksite, 1st Floor Master Bedroom  Employees removed and installed insulation in an attic area directly above the 1st floor master bedroom, without any form of fall protection. The employees worked and traversed across the open 2 x 12 engineered floor joists and were exposed to falls of up to 10 to the next lower level.  The employees did not recognize the hazard; were unaware of the procedures to minimize the hazard; and had not been provided with the requisite fall protection training on, or about January 11, 2015.   Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19. Failure to comply may result in an additional penalty of $1,000.
