29 CFR 1926.1101(k)(2)(i):  Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site pursuant to paragraph (k)(1) of this section:  (a)Kimberly Hills LLC at 2305 W 92nd Avenue, Federal Heights, CO: On and before 11/19/14, before work subject to this standard began, Kimberly Hills LLC did not determine the presence, location, and quantity of ACM and/or PACM, pursuant to paragraph (k)(1) of this section.  Kimberly Hills LLC was the facility owner of the clubhouse.  J & B Refurb was hired to remodel the clubhouse, including to perform demolition of drywall that had joint compound containing approximately two percent chrysotile asbestos and to remove the upper track for an accordion room divider from a ceiling containing "popcorn" surface texture.  The joint compound was ACM.  The ceiling surface texture was PACM.  Kimberly Hills LLC did not determine that the building materials contained asbestos prior to J & B Refurb beginning work.  This condition exposed employees of J & B Refurb to an asbestos hazard.
