OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to being struck by the refuse collection truck.    (a) At multiple locations throughout northern New Jersey, in the period from January 7, 2015 to July 2, 2015 employees were routinely placed in a variety of jobs, including hazardous jobs. The employer did not ensure that hazard assessments and adequate training regarding workplace hazards were completed and did not verify that the host had fulfilled its responsibilities for a safe workplace. On January 7, 2015, at a refuse collection point at the intersection of Highwoods Drive and Black Hawk Lane in Franklin Lakes, New Jersey, a crew of three refuse lifters were collecting refuse and placing it into the garbage truck. One of the lifters was struck by the garbage truck as it backed into Black Hawk Lane and was run over by the truck. He died as a result of his injuries.
