29 CFR 1928.57(a)(6) At the time of initial assignment and at least annually thereafter, the employer did not instruct every employee in the safe operation and servicing of all covered equipment with which he was or would be involved including at least the following safe operating practices; 1928.57(a)(6)(iv): Make sure everyone is clear of machinery before starting the engine, engaging power, or operating the machine: At the time of the inspection, employees had not been trained in the safe operation of the skid steer loaders or front loaders. Employees had not been trained on the operators manuals which included specific safety instructions and warnings for the covered equipment. The inspection found that a skid steer loader was operated with an employee in the vicinity and a struck-by injury occurred. The employer had no record that employees were instructed at the time of initial assignment and at least annually.

29 CFR 1910.178(l)(1): 1910.178(l)(1)(i): At this establishment, the employer had not assured that the forklift operator was competent to operate the New Holland L885 Bobcat, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of operating farm equipment without training on the hazards associated. At the time of the inspection, employees had not been trained in the safe operation of the skid steer loaders or front loaders. Employees had not been trained on the operators manuals which included specific safety instructions and warnings for the covered equipment. The inspection found that a skid steer loader was operated with an employee in the vicinity and a struck-by injury occurred. The employer had no record that employees were instructed at the time of initial assignment and at least annually. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to implement a training program as required by 1910.178(l).
