29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  a) Jobsite, 1613 S. 21st Street - Employees were performing masonry operations from the second and third level of the fabricated frame scaffold approximately thirteen (13) feet above ground level without the use of personal fall arrest or guardrail systems.  Observed on or about 1/16/15.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a) Jobsite, 1613 S. 21st Street - Employees were performing masonry operations within inches of unprotected edges from a fabricated frame scaffold 13' above ground level without being trained in scaffold safety.  The exposed employees did not know the trigger height for fall protection from fabricated frame scaffolds on or about 1/16/15.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a) Jobsite, 1613 S. 21st Street - A ladder or other safe means of access was not provided to employees performing masonry operations on the fabricated frame scaffold.  Employees were using the side frames and cross-braces as a means of access/egress, thus being exposed to fall hazards greater than thirteen feet above ground level. Observed on or about 1/16/15.

29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph.  a)  1613 S. 21st, Philadelphia, PA - Employees were working from a fabricated framed scaffold five (5) sections high, which was not guyed and tied to the structure thus exposing the employees to fall, collapse and struck-by hazards.  This condition was observed on January 16, 2015.

29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights is no more than 1 inch (2.5cm) wide:  a)  Jobsite - 1613 S. 21st Street, sidewalk:  Employees were exposed to fall hazards of approximately thirteen (13) feet while performing brick laying operations from a fabricated frame scaffold.  The working platform was not fully planked.  Observed on or about January 16, 2015.
