29 CFR 1910.133(a)(1): The use of protective eye and face equipment was not enforced at all times where there was a reasonable probability of injury that could be prevented by such equipment: (a) On or about January 6, 2015, for an employee who was exposed to caustic battery acid and was hospitalized with face and eye injuries after a battery exploded at Gold Star site four miles south of Highway 23 on 89th Avenue NW, New Town, ND 58763.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: (a) On or about January 6, 2015, for an employee who was hospitalized after attempting to charge a 12-volt lead acid battery which exploded at Gold Star site four miles south of Highway 23 on 89th Avenue NW, New Town, ND 58763.
